Acceptance of Terms
By accessing, browsing, or using the Polking platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these Terms, you must immediately cease all use of the platform. You must be at least 18 years of age to access or use Polking; by using the platform, you represent and warrant that you meet this age requirement.
Platform Description
Polking is a Decentralized Ads Protocol built on the BNB Smart Chain (BSC). Users purchase nodes using USDT (Tether) on BSC. Active nodes accrue a fixed simple daily return, and Users may activate engagement missions that unlock daily engagement tasks across multiple social media and advertising platforms. The platform operates a multi-level referral network with rank-based commission structures, providing additional rewards through sponsor bonuses, matching commissions, and lucky draw mechanisms.
Definitions
Throughout these Terms of Service, the following defined terms shall have the meanings set forth below. "Platform" refers to the Polking application, website, and all associated services. "User" means any individual who accesses or uses the Platform. "USDT" refers to Tether, a stablecoin pegged to the United States Dollar, deployed on the BNB Smart Chain. "PK" refers to the native utility token of the Polking ecosystem (symbol POLKING / PK). "Node" means an on-chain position purchased with USDT that accrues a fixed simple daily return. "Active Mission" means the aggregate value of all currently active engagement missions associated with a User's account. "Task" refers to any engagement activity presented to a User through the daily task pool. "Referral Network" refers to the multi-level organizational structure connecting Users through direct and indirect sponsorship relationships. "Rank" denotes a User's tier within the platform hierarchy, ranging from PK-0 (base) through PK-15 (highest).
Eligibility
You must be at least 18 years of age and possess the legal capacity to enter into binding contracts in your jurisdiction to use Polking. You are solely responsible for ensuring that your participation in the platform complies with all applicable local, state, national, and international laws and regulations governing digital assets, cryptocurrency, and online engagement activities. The platform reserves the right to refuse service, restrict access, or terminate accounts at its sole discretion. The Platform does not perform Know Your Customer (KYC) verification, though we may be required to collect additional information if compelled by applicable law.
Account Registration & Security
Your wallet address is your account identifier on the Platform. Authentication is performed by signing a nonce with the wallet's private key — the Platform does not store email addresses or passwords. Each wallet is permitted to maintain only one account; operating multiple accounts through coordinated wallets constitutes a violation of these Terms and may result in suspension. An optional username may be registered once via the on-chain UserRegistry contract and cannot be changed thereafter. You are solely responsible for the security of your wallet and its private key; loss of the private key may result in permanent loss of access to your account and associated on-chain assets. You must notify us immediately at support@polking.app if you suspect unauthorized use of your wallet in connection with the Platform.
Node Purchases & Missions
Users may purchase nodes on the BNB Smart Chain using USDT, subject to a minimum and maximum purchase amount configured by the Platform. An active node accrues a fixed simple daily return computed off-chain on a per-second basis, and continues to accrue until the node end date or program-wide maturity. Users may also activate engagement missions, each returning 0.3% of the activation amount, paid in PK. Users may complete a maximum of 5 missions per day, up to 300 missions in total over an approximate 60-day cycle. Engagement earnings are subject to a 2.5x earning cap — once total earnings attributed to an activation reach 2.5 times its activation amount, it automatically closes. Multiple activations may run concurrently, and a single mission completion advances all active activations simultaneously. Node purchases and mission activations are non-refundable, and expired activations close automatically at the end of their cycle.
Staking & Live Rewards
Active staked positions accrue "live rewards" — a variable daily return that the Platform configures within a range of 0.2% to 0.7% per day, accrued continuously on a per-second basis on the staked value. Live rewards are paid in PK and are in addition to mission rewards and to any referral, matching, ranking, or lucky-draw bonuses. The daily live-rewards rate is set by the Platform and may change from day to day; rate changes take effect prospectively and do not apply retroactively to rewards already accrued. All earnings attributed to a staked position — live rewards, mission rewards, and bonuses combined — are subject to a 2.5x cap; once total earnings reach 2.5 times the staked amount, that position stops accruing and closes. Rewards accrue off-chain and are credited on-chain when claimed; no return is guaranteed and rates may be reduced to the minimum at the Platform's discretion.
Task System & Earnings
The daily task pool draws from multiple social media and advertising platforms, with each platform contributing tasks at varying difficulty levels. Users advance through per-platform levels sequentially, unlocking new tasks as they progress. Tasks are verified through multiple mechanisms including timed engagement, link review, referral milestones, rank achievements, team membership thresholds, and group membership checks. A single mission completion simultaneously advances all of a User's active activations. The per-mission reward is calculated as the User's total Active Mission value multiplied by 0.3%, paid in PK.
Referral Program & Commissions
Polking operates a referral commission structure where rates vary based on the sponsor's rank. A 10% matching bonus is distributed to the direct sponsor (L1) on task completion. All referral commissions are paid in PK and are subject to the per-activation 2.5x earning cap. Artificial referral inflation — including but not limited to self-referral, Sybil referral networks, or incentivized sign-ups without genuine engagement — is strictly prohibited and will result in account termination. Participation in the referral program does not guarantee any income; earnings depend entirely on the legitimate engagement activities of your referral network.
Lucky Draw (Gacha) System
The lucky draw system is a planned feature that, when released, is designed to provide bonus reward opportunities triggered by network activity. The intended design awards Egg draws to Users upon mission activation (1-10% of the activation amount), Treasury draws to the direct sponsor (L1) at 1-8% of the referral's activation amount, Orb draws to L2-L3 upline sponsors at 0.5-5%, and Rank draws to L4-L10 upline sponsors who maintain an active mission, at 0.1-2%. Lucky draw features are not currently active on the Platform; the parameters above are indicative only and may change prior to release. When released, all lucky draw outcomes will be probabilistic with no guaranteed prize amount or frequency, and all prizes will be subject to the per-activation 2.5x earning cap and may be partially or fully capped.
PK Token Disclaimer
PK is a utility token designed for use within the Polking ecosystem. PK is not a security, investment contract, or financial instrument of any kind. The platform makes no representations, warranties, or guarantees regarding the current or future monetary value of PK tokens. PK token value is subject to market volatility and may fluctuate significantly or decline to zero. The platform has no obligation to repurchase, buy back, or maintain the value of PK tokens. The burn mechanism reduces circulating supply over time but does not guarantee price appreciation. Nothing in these Terms or on the platform constitutes financial, investment, or legal advice.
Risk Disclaimer
Participation in the Polking platform involves significant risks inherent to digital assets and blockchain technology. These risks include but are not limited to: volatility in digital asset values, smart contract vulnerabilities or failures despite security audits, BNB Smart Chain network risks including congestion, forks, or downtime, and evolving regulatory uncertainty across jurisdictions. You should only commit funds that you can afford to lose entirely. Past performance on the platform is not indicative of future results. The information provided on the platform does not constitute financial, investment, tax, or legal advice, and you should consult qualified professionals before making any financial decisions.
Prohibited Activities
The following activities are strictly prohibited on the platform and will result in immediate account suspension or permanent termination: fraud, misrepresentation, or deceptive conduct of any kind; market manipulation or artificial inflation of earnings or referral metrics; Sybil attacks, including the creation or operation of multiple accounts by a single individual or coordinated group; exploitation of platform vulnerabilities, bugs, or errors (which must be reported immediately); money laundering, terrorist financing, or sanctions evasion; automated or bot-driven activity unless expressly authorized; abuse of referral mechanics including but not limited to wash referrals and circular deposit schemes; and harassment, threats, or abusive conduct directed at other Users or platform personnel.
Intellectual Property
All intellectual property rights in the platform — including but not limited to source code, smart contracts, user interface design, graphics, logos, trademarks, and branding — are and remain the exclusive property of Polking. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the platform for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, reverse-engineer, decompile, or create derivative works based on any aspect of the platform without prior written consent. By submitting any content to the platform, you grant Polking a worldwide, royalty-free, perpetual license to use, display, and distribute such content in connection with platform operations.
Limitation of Liability
The platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Polking, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from: fluctuations in PK token or other digital asset values; smart contract failures or vulnerabilities; BNB Smart Chain network disruptions, congestion, or forks; third-party service disruptions; or unauthorized account access resulting from User negligence. In no event shall the aggregate liability of Polking exceed the total amount spent by the User on the Platform in the twelve (12) months preceding the claim. Neither party shall be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, government actions, network failures, or cyberattacks.
Indemnification
You agree to indemnify, defend, and hold harmless Polking, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use or misuse of the platform; your violation of these Terms or any applicable law or regulation; your violation of any rights of a third party; or any fraudulent, negligent, or intentionally harmful activity conducted through your account. This indemnification obligation shall survive the termination of your account and these Terms.
Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the platform, the parties agree to first attempt resolution through informal negotiation by providing written notice to the other party, with a thirty (30) day period to resolve the matter informally. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with its then-current rules. These Terms and all disputes hereunder shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to conflict of law principles. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration. Notwithstanding the foregoing, either party may seek relief in a small claims court of competent jurisdiction. Each party shall bear its own costs and attorneys' fees in connection with any dispute resolution proceedings.
Modifications & Termination
Polking reserves the right to modify, amend, or replace these Terms at any time. For material changes, we will provide at least thirty (30) days' advance notice via prominent in-Platform notification prior to the effective date. Your continued use of the platform after the effective date of any modification constitutes your acceptance of the revised Terms. The platform may suspend or terminate your account at any time for violations of these Terms, suspected fraudulent activity, or for any other reason at its sole discretion. Upon termination, any pending withdrawal requests will be processed subject to verification and compliance review. Certain provisions of these Terms shall survive termination, including without limitation the sections on Limitation of Liability, Indemnification, Dispute Resolution, and Intellectual Property.
